Acceptance of Terms
By accessing or using Eterna ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. These terms constitute a legally binding agreement between you and Eterna LLC ("Company," "we," "us," or "our").
Service Description
Eterna provides digital memorial and legacy preservation services, including AI-powered persona creation, memory storage, voice synthesis, and memorial sharing. We are not a funeral services provider, estate planning service, or legal counsel. Any third-party disposition services (cremation, memorials) are provided by independent partners, not by Eterna.
User Accounts & Eligibility
You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information. Accounts created on behalf of others (e.g., memorializing a deceased relative) must be authorized by the estate or legal representative.
Acceptable Use
Eterna is a personal legacy preservation and memorialization platform. You may only upload content that you own or that you have explicit permission (or clear legal authority, such as being the legal representative of an estate) to use. You may NOT use Eterna to create AI voices, likenesses, videos, images, or personas of celebrities, public figures, or any third party without their documented authorization. Eterna may not be used to generate impersonations, deepfakes, satirical impersonations, or unauthorized representations of real people. The service is intended solely for individuals preserving their own legacy or for families memorializing loved ones with appropriate rights. You also agree not to upload content that is illegal, defamatory, harassing, hateful, sexually explicit, or infringing on intellectual property rights. We reserve the right to remove content, suspend, or terminate accounts violating these rules, and to cooperate with law enforcement where required.
Content Ownership & License
You retain ownership of the content you upload. By uploading content, you grant Eterna a non-exclusive, royalty-free license to host, display, and process your content solely for the purpose of providing the Platform's services. This license continues for the duration of your subscription or legacy plan.
AI Voice & Persona Technology
Our voice synthesis and AI persona features require explicit consent from the person being memorialized or their legal estate. You warrant that you have obtained all necessary rights and consents. AI-generated content is an approximation and should not be considered a perfect representation of the deceased.
Subscriptions & Billing
Premium and Heirloom tiers are billed according to your selected plan. Subscriptions auto-renew unless cancelled. The Heirloom fee is a one-time onboarding investment; ongoing access requires an active Premium subscription. Payment, billing, tax, cancellation, and refund mechanics are governed by our Refund Policy and by Paddle's Buyer Terms at https://www.paddle.com/legal/checkout-buyer-terms.
Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns, refunds, chargebacks, invoicing, and applicable sales tax and VAT on our behalf. When you purchase from Eterna, you are also agreeing to Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms). Charges on your statement may appear as "Paddle.net* Eterna" or similar.
Termination
You may cancel your subscription at any time. Upon cancellation, free-tier limits apply. We may terminate accounts for violations of these terms. In the event of account termination, we will retain data as required by law or for the duration of any legacy hosting guarantee.
Limitation of Liability
Eterna is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Delaware.
